Recent federal rules changes that took effect December 1, 2016 have eliminated the 3-day grace period for electronic filing in both civil and criminal cases. See Fed. R. Civ. P. 6(d), Fed. R. Crim. P. 45(c). The Supreme Court has ordered that the new rules apply “in all proceedings in civil cases thereafter commenced and, insofar as just and practicable, all proceedings then pending”. For purposes of filing in this Court, the new rule eliminating the grace period will apply to all pending cases, unless the attorney specifically files a motion asking the Court to apply the grace period as being "just and practicable" in their case.
